DBA Lawyer Straight Talk: Why You Should Try To Return To Work After Your Defense Base Act Injury

DBA Lawyer Straight Talk

If you are a seriously injured Defense Base Act Worker - you need to know the facts of life. We give it too you straight. No sugar added. Just good old fashion truth. We will tell you the truth, even if that isn't what you want to hear. More importantly, the truth is what you need to hear. If you Google "DBA Lawyer Straight Talk" or "DBA Attorney Straight Talk" you will find dozens of great articles by a Defense Base Act Lawyer that will help you win your DBA case.

It's A Wage Loss Concept

When you are a Defense Base Act worker and you are seriously injured and unable to return to your previous DBA employment due to your injuries then you may be entitled to lifetime weekly compensation benefits under the Defense Base Act. If you have been following our previous articles, you know that for Unscheduled Injuries - the Defense Base Act uses a wage loss concept. Meaning, your weekly disability is determined by the difference between your DBA earnings and what you are able to earn now (read: post-injury) in the area where you live after considering your disability, age, education, training, etc.

This is a Two Part article. In these articles we explain why it is usually in your best interest to return to work before your Defense Base Act trial. Be sure to check out Part Two of this article, "DBA Attorney Straight Talk: Why Returning Back to Work Will Help You Win Your Defense Base Act Case."

The Practical Side

We usually advise our clients to live their life as if they did not have a Defense Base Act claim. What does this mean? It means that there are no certainties in life or in law. Or as Robert Hunter said, "Nothing's for certain. It can always go wrong." In other words, you can always lose your DBA case. Seriously. It can happen.

Which is only part of the what is going on here. In addition, Defense Base Act Judges see it all. In my view, these Judges are a tad conservative, by and large. Which is okay - so are most of our DBA clients, when you get down to it. These DBA Judges see their share of injured workers that think once they get injured they have hit the lottery and will never have to work again. While these folks may have legitimate injuries - - it might be a far stretch to suggest they can never work again. These workers may come off or at least give the impression they are lazy and/or trying to milk the system.

You don't want to be that guy or gal. So don't be. Even if you were very seriously injured, in most cases (but certainly not all cases); there is some type of gainful employment you can perform.

The DBA Wage Loss Concept In The Real World

Remember, we are talking about a wage loss concept. The way this usually plays out is the DBA insurance company will have a Labor Market Survey prepared showing all these jobs (in your geographic area) that you are allegedly able to perform and are available for you to perform. You need to immediately apply for each and every job in the Labor Market Survey. You need to carefully record and document your efforts to get these jobs. If you actually get one of these "jobs" - that is great. But chances are, you won't.

Disclaimer

This article is not legal advice. I am simplistic in order to achieve clarity. Your case may differ than those described in this article. If you are a seriously Defense Base Act worker you need to hire the best DBA Lawyer that you can find. When you bring a Deense Base Act court case, your credibility is at issue. If the Judge doesn't believe you - you will lose your case. Always tell the truth. Always.

Should You Hire An Attorney For Traffic Violation Mishaps?

If you've received a ticket, are you wondering if you should hire an attorney for traffic violation mishaps? If so, hopefully this short article will be able to simply guide you.

Many people often wonder if it's to their advantage to even consider hiring a lawyer who is an expert in traffic laws. It's very possible to represent yourself in a court of law if you do your homework. It's probably more likely you will stand a better chance of success in your case if you hire a lawyer who knows the law.

The most obvious disadvantage of hiring a lawyer has to be the money you will pay him. He's certainly not going to help you for free. This fact alone prohibits many people from seeking their help. It can be very expensive.

In my opinion, the times I would definitely seek a lawyer's help no matter what it costs would be the following:

- If I was going to lose my license.
- If I was facing a jail sentence.
- If my fines were extremely heavy.

Otherwise, if my violations weren't so major, I would most likely try to defend my own case. And, keep in mind, even in some cases even though you hire an attorney for traffic violation mishaps it doesn't guarantee you will win your case. If he loses your right to fight the violation, you will still have to pay his fees as well as the court fees.

I'm certainly not trying to dissuade you or scare you in regards to your violations. These are definitely serious issues that need to be resolved with the most beneficial help you can afford. I'm just seeking to list some pros and cons of either hiring an attorney for traffic violation mishaps or not.

Another great reason for hiring one is if your ticket was received in another state than in which you live. Your injuries, if any, and job schedule may not allow you the freedom to visit the court in the other state at the times required. It would be great to know someone can represent your case when you cannot.

If you choose to represent yourself in court in the state you reside, here is a small list of preparations which will greatly benefit you:

- Take pictures of where you got your ticket of signs, road conditions, etc.
- Write out a detailed events timeline of the violation situation.
- Be prepared with some probable reasons why the officer in charge interpreted the facts as he saw them.

Bottom line?

Be prepared for anything. The severity of your case will be the determining factor whether or not you hire an attorney for traffic violation mishaps. As stated before, there are certainly some major cases which will require the expert assistance of a good traffic lawyer. But in other, more minor, cases, it's fairly safe to say you can defend your own case and save your money for other worthwhile purposes.

Obtaining an ashburn ga attorney for traffic violation  cases can help you avoid fines and higher insurance costs. Keep money in your pocket and your car on the road:  http://www.ticketforspeeding.com/.

Why Should I Hire A Personal Injury Attorney?

A personal injury can affect your life for many years. However, it can even result in financial, physical and emotional suffering for you and your family. Suffering an injury of this type can be difficult. Regardless of the person, intent or the company, whose negligence was accountable for your injury, and can be held liable for the damages that you may have incurred. By consulting a competent lawyer, the damages of the case can be calculated and explained.

A personal injury is a legal term that has been used for the kind of injury which occurs to the mind, emotions or body rather than an injury to property. This can be distressing especially if you have suffered this as a result of an accident, which was not your fault. Having such an injury can automatically give the claimant a right for compensation. The specialists who claim such a case can guarantee you compensation quickly. If this type of injury is related to class action it can be heard in either state or federal court. Also, these specialists deal with claims that are related to this type, and which are caused by direct result of another person. On the other hand, they also help if you are unsure whether you have a claim or not. The court will determine the damages, if the claims for the injury have been proved.

However, as discussed earlier, this type of injury can be either physical or psychological. In matters of law, this is defined as any damage that results from another person's careless, reckless or negligent actions. A victim deserves to be rightly compensated for such traumas as well as the physical injury, when such a personal injury has been caused by the intent or negligence of another person.

Many a times, you may be unsure if your personal wound is actionable or caused by negligence. As previously mentioned, this can come from many places. You should understand what exactly this personal damage means in your state is. However, in order to file a lawsuit for you to recover the damages caused by the injury, it should work only if it is a result of an attack, an accident or negligence. Reading through the passage, you should have understood that this is more than an injury occurred by one's self and is definitely not a person problem. If this type of claim has been sustained then a personal Injury lawyer will have the experience to advice on the potential of the claim.

The Basics of Bankruptcy: Should You Hire an Attorney?

Having to file for bankruptcy can be an extremely difficult decision, one filled with stress and trepidation. Most everyone is concerned with the consequences of filing and the reaction they receive from their peers and relatives. Sometimes one's finances can spiral out of control and bankruptcy can often be the best solution and means to a fresh start.

What exactly is bankruptcy?

When bankruptcy is declared, an individual or business is then officially placed into a protective state under a legal status which stipulates they are no longer able to pay off their debts. One may file for bankruptcy protection to avoid harassment from creditors and sometimes even have some debts dismissed. It can provide you with a chance to reduce much of the debt burden and organize your finances once again. Occasionally a person or entity is forced into involuntary bankruptcy which occurs when creditors force the issue legally in court so as to curb their losses. But the eventual outcome of a bankruptcy filing varies between debtors. While some debtors are able to get a large sum of their debts discharged, others are able to rearrange their outstanding bills into a plan for repayment. There are many different types, laws, and proceedings related to bankruptcy; a good resource for reviewing some of this data is on the Federal Government website for bankruptcy.

Why should you hire an attorney?

Although you are not technically required to hire an attorney to file for bankruptcy, doing so can save you a lot of time, hassle and headache. Attempting to complete this process alone can result in an extended, complicated and risky situation. There are many rules and regulations associated with the process of filing for bankruptcy and hiring the right attorney can be the best decision you make in the entire process. Not only can a lawyer help you understand these rules and which apply to you, the attorney can assist by negotiating with creditors and prevent the mistakes that people often make. They can also provide guidance on staying financially stable after your filing and help protect you against harassing creditors prior to your filing.

Once you take the first step of hiring a bankruptcy attorney, you are now legally being defended. Creditors may only communicate with you by way of your lawyer and can no longer demand payments. This alone can make a dramatic impact to an individual who has encountered endless phone calls and letters from creditors demanding funds one just does not have. This is just one example of the peace of mind one receives when knowing that a professional is working the case focused on what is best for them.

In addition to reduction in your mental anguish, there are other valid reasons you should hire a skilled and competent bankruptcy lawyer.

1. A bankruptcy attorney will help determine the proper chapter of bankruptcy you need to file.

The fact is there are several chapters of the bankruptcy protection law available to you. It is imperative you file under the proper chapter to get the protection you deserve and require. More importantly each chapter has its own different result if you are successful in your court petition. This alone is justification for hiring the services of an expert. A lawyer can help you decide and understand which chapter you should file to properly protect yourself and your family. Normally this type of consultation is no charge. Many attorneys offer a free case review while others charge by visit or activity.

2. A bankruptcy professional will guide you through each step of the legal process.

When you are under a large amount of financial stress it is common to find it difficult to focus on specific matters you must accomplish, especially with our court systems. Additionally your bankruptcy counsel will help deal with creditors, gathering documentation, filing schedules requested by the court and establishing payment plans.

3. Your lawyer can guide you through the paperwork process.

The paperwork involved in filing for bankruptcy can be overwhelming and often difficult to understand. A good bankruptcy attorney can reduce the burden of having to decipher the plethora of paperwork during this emotionally troubling time in your life.

4. A bankruptcy lawyer can devise a payment plan that will satisfy your creditors.

An experienced bankruptcy lawyer will deal with your creditors and will establish a payment plan that is within your means that you can live with. Normally creditors are satisfied with the plan that is presented to them by a lawyer because it shows that you are making an attempt to pay your debts. Also the knowledge that creditors have that you have retained counsel helps stop the aggressive phone calls and collection attempts by your creditors.

Once you have decided that hiring a bankruptcy lawyer is the right thing to do, it is imperative to find a competent attorney that will best be able to help you with your case.

One of the best resources for the names of quality bankruptcy lawyers within your area is, of course, the courthouse. Visit a bankruptcy court and ask for recommendations. While you are there, try to see and experience a bankruptcy case, so you will get an idea of what to expect. This will also give you some insight on the steps a lawyer has to go through while defending you.

Word of mouth is the best source of information about the most respected bankruptcy lawyers. Consider asking your trusted friends and family and collect that information. Find out who represented them in the court and what the outcome of the case was. If you follow these steps, you are that much closer to releasing yourself from your financial turmoil and seeing the light at the end of the tunnel.

What Physicians Should Know About Insurer's Retrospective Audits

What are retrospective audits?

Once insurance claims are settled, physicians' practices hope, and probably assume, that the claims won't be revisited. The American Medical Association (AMA) and American Academy of Neurology presented a cautionary report, updated in 2010, warning physicians that insurers may be taking a backward look at previously settled transactions from even years earlier.

A Retrospective Audit is when insurers review past claims they think were overpaid and seek repayment for some of the amount. The audits may reveal legitimate discrepancies at times, but audit findings are not always appropriate and physicians are entitled to certain rights and knowledge of the accusations and processes to follow.

How might you be at risk?

Insurers are checking for a variety of reasons to run a retrospective audit on a physician's practice. Aside from randomly conducted audits, here are a few specific reasons why insurers might look into your practice:

High service volume
To insurers, a physician practice with high service volume may imply over-use of reimbursable services.

Coding issues
When insurers spot repeated use of the same evaluation and management services, for complex and varying cases, they assume inaccurate reporting and violation of Current Procedural Terminology (CPT) codes set forth by the AMA.

Modifiers
The CPT modifier 25 is used to report an evaluation and management service on a day that the same physician provided another service to the patient. Insurers become suspicious when a practice frequently reports a modifier 25.

Recovery Audit Contractors
Recovery audit contractors (RAC's) help determine improper payments to physicians. Each physician practice should review its RAC's website to stay current on the issues that the RAC's will focus their audits.

What should you do if selected for an audit?

Practice your right to be informed! Make important inquiries about the insurer conducting the audit and the process involved. Ask state and county medical associations and national medical specialty societies. Ask the American Medical Association and any government agencies that regulate insurance. These organizations will be able to provide valuable information and will also be alerted that insurers are conducting possible unfair practices against physicians.

Additionally, reviewing current guild lines and codes while comparing them with your current billing and coding practices is important to prove patterns of compliance, and therefore, to help validate claims billed to the insurer. Reviewing the contract that the practice holds with the insurer is also a helpful preparation for an audit. It may yield protections for the practice against the insurer's accusations.

If the health insurer is noncompliant with state laws, in your particular case and has had a pattern of noncompliance in the past, the best step forward is to obtain legal counsel for following necessary litigation. Physicians' practices should be aware of the risks before they are selected for an audit, but if the insurer has already chosen you, there are resources to utilize and steps to take for protection.

Real Estate Attorney - Why Should You Hire Him?

Every man dreams of owning a luxurious house; however, not everyone can afford to make their dreams come true. Planning to purchase a house is one of the biggest decisions in our life. These days, buying a property is not as simple as it looks, because it involves a lot of investment and documentation. So, if we don't act carefully, there are chances that we end up with huge losses, which may take a lifetime to recover back. While buying a house or a property, it is always better and safer to involve people who have complete knowledge regarding the documentation work and all the do's and don'ts. Then, the next question is who is more knowledgeable than a real estate lawyer in dealing with such issues? Well, the answer is none. Since these lawyers are in the same profession, they might have seen many cases. Therefore, they know all the loopholes in the transactions and when hired them, they make sure that your transaction is legal without any hassles later on.

It is not necessary that everyone should hire a lawyer while buying property. But, it is true that by hiring a lawyer you will not face any legal issues later on. So if you don't want to have a risk of legal issues, getting professional help is highly advisable. One needs a real estate lawyer, whether you are buying or selling a property. Basically, real estate attorney assists in many issues related to negotiation, reviewing transactions, getting a bank loan, verifying authenticity of the seller, settling disputes etc.

Once you have decided to seek a professional help, look for a competent real estate lawyer in your state. For this, you can either search online or consult a law firm in your state. You can also get the list of lawyers from newspapers, yellow pages or through referrals. The best source of all those mentioned for finding a competent lawyer is referrals. Ask your friends or family members, if they know any real estate lawyer. If yes, then ask their experience with him, like his competency, transparency, and fee structure etc. If you don't have any referrals, continue with other modes of search and shortlist a few lawyers. While searching for a lawyer, check their qualifications, experience, competency, success rate and fee. After short listing a few, fix an appointment and meet them personally.

However, do remember that not every lawyer you have shortlisted will be interested to take up your case. Since they are reputed lawyers, they may not be willing to take up every case and they may ask you a few questions. So, be prepared while going to meet him and carry all the necessary documents. In your first meeting, the lawyer may ask your personal details like your profession, family information, contact details and your business background if you are a businessman. He may also ask you questions regarding the persons involved in the deal so as to make sure that your deal is genuine without any conflict of interest. He will also make sure that there are no legal disputes regarding the property you are planning to buy. He may ask for the original documents, photographs or memos with regard to your deal. Once he is satisfied with all the details and paperwork you have shown to him, he will take up your case.

Similarly, you should also ask him a few questions regarding his professional experience and expertise, number of cases he has taken up, his success rate and any problems which you may face later on with regard to the property you are planning to buy or sell. Since you have done a check on his background, check if the information he has given to you regarding his experience is true or not. If he proves to be genuine, go ahead and hire him.

Bail Bonds: What You Should Know Before Choosing a Bondsman

Even if you have an idea about what bail bonds are all about, you may not be prepared for the day upon which you'll need one. Unfortunately, once the time strikes that you do need to get yourself or someone you love out of jail, there won't be a lot of time to leisurely educate yourself about who to get for the job. Whether you're looking for immediate need or for future reference, here are three things you should know before choosing a bondsman.

License

A company or individual involved in bail bonds needs to be appropriately licensed by the state in which they practice. Every state will have their own department through which this is done, and it may be worth giving that department a call just to make sure. This is the last thing you want to have done in a below-the-table kind of way. Everything should be legal and above board. In some cases, the sum behind these bail bonds can be considerable. Make sure you aren't going to have mob types looking for you if there's a problem in the future.

Locale

There's nothing inherently terrible about getting your bail bonds from a company that does business across the country, but you're probably better off finding someone local. The wheels of justice move as quickly or slowly as the people in charge want them to move. If you have someone who is friends with most of the people at the jail, it could certainly work to your advantage, assuming you don't want to spend three or four extra days behind bars once you've come up with the money.

Longevity

When it comes to any service industry, having been in business for a long time is a good sign. People who cheat their customers, circumvent the law, and generally do a terrible job don't stay in business for long. Or at least not in the same location. If all things are equal and you're deciding between a guy who has been doing this for six months and another guy who has been working in the area for ten years, the choice should be obvious. Even if you have to pay a little more for the experienced guy, it's probably worth it.

If you can come up with the money to spring yourself from jail, by all means do so and avoid the fee that will be charged by going through a bail bonds company. If you need some help coming up with the sum, like many, make sure you find someone reputable.

Drunk Driving and What Your DUI Lawyer Should Be Interested In

If you intend to contest any aspect of your drunk driving arrest, you need a good DUI lawyer by your side. There's certainly nothing in the law that states that you cannot act as your own attorney, but it is not a recommended course of action. Even if you have a good working knowledge of the law, you're far better off being represented by someone who has the experience and education necessary to provide you with a good defense. Of course, not every lawyer is created equally. If you don't feel you're getting an adequate defense for your money, it is your right to find someone else. Here are some of the things your attorney should be interested in, regarding your case.

Your Activities and Consumption

If your DUI lawyer isn't asking you any questions about what you were doing prior to being arrested, then he isn't doing his job. This is crucial to the case at hand and may very well be the information that makes or breaks the case. Were you at a bar? A party? Were you sitting home, drinking in front of the TV? While the law doesn't care where you consumed the alcohol before deciding to get behind the wheel, these details could matter when it comes to determining how inebriated you were at the time -- if at all. If there were witnesses in attendance, they may need to be called for interview and possibly to testify on your behalf.

Officer Interaction

This is where the rubber meets the road, so to speak, and it is the very point upon which many a DUI lawyer has found his defense. A police officer must be very careful to uphold a citizen's rights when detaining them for questioning or sobriety tests. If your rights were trampled during this time, it could be enough to throw out the whole case. Many communities are understandably vigorous when it comes to pulling drunk drivers off the road. However, there is a difference between vigilance and overstepping the boundaries of the law. Your attorney should be very interested in figuring out which happened in your case.

Your Criminal History

While prosecutors are forbidden to bring in prior criminal history to argue a case against a defendant, it is sometimes wise for a DUI lawyer to bring up the lack of one as an argument for their client. If this is the fourth or fifth time you've been in trouble with the law, the judge is much less likely to show you leniency than if this is the first time you've ever been arrested.

The Questions That Should Be Asked Before Hiring a Medical Expert Witness

Winning a case, whether it is a criminal trial or a civil lawsuit, can be quite tough. In certain cases, the prosecution or corporate clients may seem too powerful to overcome in court. One way to get an edge, however, is through the use of a medical expert witness. However, before a person's lawyers hire one, certain things should be considered.

1. What Kind of Medical Expert Witness Should Be Used?

The kind of medical expert witness that is used depends on the circumstances and facts surrounding each different case. For example, a case may involve a death by poisoning. If that is true, a forensic toxicologist could be hired to provide the expert witness testimony needed. Another case may involve blood samples left at the scene of the crime. In this case, a DNA forensic expert should be used instead.

2. Is the Expert Credible?

The qualifications and credentials of an expert are just as important. If a jury becomes skeptical of an expert witness's actual expertise in regards to the science being examined, this can change the entire verdict. A witness's background should be examined thoroughly. This includes that expert's education, tenure at universities, published research and time spent in the field. Overall, that person's breadth of knowledge on the subjects related to the case must be verified to actually be expert level.

3. What Is the Expert's Temperament?

Breadth of knowledge isn't the only thing important when it comes to expert witness testimony. That medical expert witness's temperament is also extremely important. This is due to the fact that juries can be swayed by the emotional aspects of a case in addition to the information provided.

For example, a certain medical expert witness may become agitated by the questions asked during cross examination. That can be devastating to the defense or the prosecution. Overall, the jury wants to discover as much pertinent information as possible. Some of that information is discovered through cross examination. An expert that appears annoyed or angered by these questions may come off as arrogant or not credible to the jury.

4. Could the Expert's Testimony Conflict with Your Side?

Another common pitfall is medical expert witness testimony that actually conflicts with oral arguments or other evidence produced by the lawyers that called that witness. This can certainly backfire and cause the prosecution or defense to lose the verdict.

This can happen for a number of different reasons. Not interviewing an expert witness thoroughly beforehand and discussing how that witness will respond to all possible lines of questioning is often the cause of such fumbles. Preparation is always key to winning a court case. This is no different when it comes to calling a witness.

The 501c3 Application - What You Should Know

The process for applying for the 501c3 application is thought to be a lot more complex than it actually is. Most people know that the 501c3 application is used by a church to get relief from taxes. However, that is just the tip of the iceberg. It is also used by corporations, community chest funds, foundations, and organizations for purposes that are charitable, scientific, religious, literary, and educational in nature.

The purposes could also be to promote amateur sports and in some cases even research. Needless to say, a wide variety of organizations fall under the categories enumerated in Section 501c3. Thus, there definitely exists a broad section of society who needs guidance on the application form and how to go about filling it out.

So what if you were looking to set up a non-profit corporation? Your confusion would be even more prominent and you wouldn't know where to begin. It is also not necessary to pay someone else to fill out your forms when setting up a nonprofit. If you have a legal background, you should use it to its fullest, but if you don't it is advisable and much more convenient to have some help. Moreover, you may also end up doing a balancing act, since if the business is meant to be not for profit, it would not make any sense to blow up a lot of money on setting it up!

The 501c3 application lets you create an independent nonprofit organization. Personally, I think that non-profit organizations have an advantage since they have no external interference. However, the paperwork needed to file the application is complex and costly, that is if you're paying someone to do your filing.

The IRS asks you to collect particular documents and fill out the form 1023 with the completion of all formalities mentioned herein. The IRS charges between $400 and $850 per application. Professional help is generally recommended since the forms are somewhat difficult to fill on your own.

Furthermore, the form 1023 may take anywhere from a couple of weeks to a couple of months to fill. Applicants usually believe that once they fill out the form they will be able to get tax exempt status in a matter of a few days. The process of tax exemption is serious and IRS processing and review can take many months.

Some important factors that can affect the IRS processing time of an application include: the type of exemption application the person has submitted, completeness of the application, and present workload of the IRS reviewers.

This article was commissioned by Nonprofit Foundry, LLC, Milwaukee WI. It is not legal advice. Every situation is unique based on facts and circumstances. If you need legal advise contact an attorney.

Should I Hire an Estate Planning Lawyer?

One of the biggest questions many families face is whether or not their loved one should hire an estate planning lawyer or not. Not only are there are a large number of lawyers qualified for this task, but there are likely many friends and family members in your address book who could refer you to one if the question of who to hire comes up. When it comes to ensuring your loved one's affairs are in order, an estate-planning lawyer is an asset.

Lawyers who are adept in estate planning can help with the following:
Writing wills and trusts: few people realize that, if you are the beneficiary or otherwise listed anywhere else on the will, you cannot sign the will as a witness. This fact is one of the biggest reasons why wills become invalid. Keeping all the documents in order, ensuring they follow the law, and making sure all the signatures are legal are some of the many tasks your estate-planning lawyer will handle. Your estate-planning lawyer will also conduct all updates to your wills and trusts as life changes occur.
Establishing a power of attorney: there are a few different types of powers of attorney, and several reasons why there are differences. This is a confusing reality, particularly if you're in the middle of a crisis situation. Your lawyer specializing in estate planning will tell you which type of power of attorney is necessary, and which is not. It is very important that you have all the proper documents in order and everything is in place in case there is an emergency.
Retirement planning: the sooner people plan their retirement, the better. Gone are the days of depending on various government benefits to see us through during our golden years. Instead, we must plan in advance. Few people realize estate-planning lawyers play an integral role in retirement planning. Your lawyer will work with your financial planner and other professionals to ensure your plan is properly put together.

Don't be frustrated if your loved one doesn't want to hire an estate planning lawyer. This isn't an uncommon reaction because, often times, individuals believe the end of their days are near and that they're going to lose control of their property, and they are not going to be able to make they're own financial decisions any longer. Reassure them that this is not the case, and they will still have full control over all decisions regarding their estate until there is medical need calling for alternate decision making through a power of attorney. Make sure they are also part of the decision making process because it is, after all, their estate in question.

Before making your final decision as to who to hire as your estate-planning lawyer, hold many interviews with lawyers in order to ensure there's a good rapport and the credentials you want to see are in place. Remember, you are going to be working with this lawyer for a long period of time, as well as their associates, so you must be able to establish a good working relationship with them. If you feel like you can't get along with them during the interview, contact additional lawyers until you feel confident you've made a good long-term decision.

Why You Should Fight a Speeding Ticket

A speeding ticket may seem like one of the easiest types of moving traffic violations to simply pay and forget about. However, if you do so, it will stick with you for some time. It will remain on your driving record long term and that could have a big impact in the long term on your ability to drive and to maintain your license. Even if this is your first instance of getting in trouble for your speed, it is a good idea to fight the charge. It is not always as difficult to do this as you may think, either.

Why Bother?

Why should you bother fighting a speeding ticket instead of just paying the bill? There are many reasons why this may make a big difference for your situation. Keep in mind in many instances, these tickets are not going to change. You will wind up paying them. However, when you can win a bit over the big guy, there are benefits you'll have as a result.

- A speeding ticket on your license will put you at a higher risk for losing your license. Once you accumulate too many points, from any type of moving violation or otherwise, you end up losing your license and driving privileges. Fighting this one means that you stay a bit farther away from that happening.

- You may end up paying high fines if you just pay it. The cost of these tickets does different significantly from one state and location to the next, but in many instances, you will pay a significant amount more if you have more than one on your driving record.

- Your insurance rates can go up because of one single instance as well. This is perhaps the biggest problem because insurance companies will likely continue to raise your rates year after year as long as you have this negative mark on your report.

What can be done? Many people do not realize that they can fight this type of charge. Attorneys can help individuals to find ways to work around this type of situation and even help the individual to avoid the fines, insurance hikes and other problems that stem from getting the violation.

A speeding ticket can mean many things to you. For some, it could mean problems with their license or even their job, if they operate a vehicle. Therefore, it is well worth hiring an attorney to help in the fight against these charges. You may find that it is not as difficult as you thought to get out of paying these high fees. Many people even find it is easy to get out of the problem quickly.

Top 4 Business Mistakes Law Firms Should Avoid

The business of law has its own set of rules and regulations. Nevertheless, as with any other businesses, it can suffer due to certain mistakes, industry inaccuracies, and errors made by law firm or its staff. Whether your law firm is large or small or whether you have a solo practice, these business mistakes can lost you dearly.

Given below are the four most common business mistakes that law firms should avoid

1. Not Focusing on Your Niche

This is particularly applicable to smaller law firms and solo practices. In an attempt to gain more clients and business, there is a temptation to spread yourself too thin and take on cases outside your area of expertise. Don't give in to this temptation. Focus on your niche, as it allows you to deliver greater client satisfaction that will automatically enhance business and profitability. Once you are well established, you may expand the services your firm provides by hiring experts in other areas. Larger law firms that handle diverse cases should assign specific areas of work such as corporate law, environmental issues, and real estate to specific people. Having everyone look at everything is a sure recipe for disaster.

2. Not Marketing Effectively

Some law firms do not believe in marketing at all and want to rely completely on word of mouth and referrals. This is a mistake. At the other end of the spectrum are law firms that spend heavily on advertising and are puzzled by the lack of results. Marketing is an essential tool to promote your law business, but it needs to be used intelligently to offer maximum value. It is not necessary to have a full-page ad in a national newspaper. You may get better results with a small ad in a local magazine that has a greater chance of being read by your target clients. Your website can also serve as a cost-effective marketing tool.

3. Not Paying Attention to Receivables

Providing the best services to clients costs money, but when clients don't honor their bills on time, most lawyers are reluctant to follow-up. Some clients may take advantage of you and delay payment even further. If this situation continues, you will be left low on cash, which will ultimately affect the quality of service. Remember that clients will not leave your firm because you ask them to pay what they owe, but they will surely leave if your level of service goes down.

4. Not Communicating with Clients

Not communicating is a common mistake that most lawyers commit without even being aware of it. The volume of work in a law firm is so large that you tend to be overwhelmed and may actually have no time to communicate with your client. Sounds unbelievable? But it is true. Communication with your clients is very important for business. You may be working very hard for their interests, but they need to know it. Giving regular updates to your clients by phone or email is essential. These are some of the most common business mistakes that law firms regularly make. Avoiding these mistakes will help keep your clients happy, and you will be able to retain them longer than you would otherwise.
